Power of Attorney

 

You can use a power of attorney to authorise your friend or relative to act for you to sell your house, rent out your apartment, open a bank account, sign a contract.

POWER OF ATTORNEY

BY THIS POWER OF ATTORNEY given on the 12th day of January the year Two Thousand and One (2001) I, WANG POH POH, a Singapore Citizen holding NRIC No. 1234567H of Apartment Block 133, Bison Street 15, #08-88, Singapore 56789, HEREBY APPOINT CHOO MEI MEI, MARY, NRIC No. 0012345J of No. 125 Mount Sinai Rise, Singapore 231456 (hereinafter called "the Attorney") to be my Attorney for and on behalf of me and in my name otherwise with the powers following exercisable in the Republic of Singapore, that is to say, to act for and on behalf of me in every respect as fully and effectual as I could act in person all my present and future affairs and property rights and interests, real and personal, with authority to bind me in relation thereto or, in connection therein, in any manner whatsoever including (but without prejudice to the generality of the foregoing authority) full power to purchase, sell, lease or otherwise dispose of and create mortgages charges thereto and to sign seal and deliver and execute documents including but not limited to contracts, deeds, Transfers, Mortgages Charges in relation thereto.

1. I hereby confer upon my Attorney the following powers and authorities:

1.1 To enter into any undertakings contracts, options for the purchase, sale or lease of any property in Singapore, and to pay or receive any such deposit or rental or other monies properly required on such matters.

1.2 To instruct on my behalf solicitors to act in the matter of the purchase, sale or lease of any property in Singapore and give such Solicitors powers to act on my behalf in all matters arising thereunder and arising in connection with any lease, mortgage, pledge, whether by deposit of deeds, equitable, legal or otherwise herein referred to.

1.3 To sign on my behalf any agreement or any other documents for any purchase, sale or lease of any property in Singapore where the same have been approved by the Attorney or such Solicitors.

1.4 To execute sign seal and deliver all such assignments, conveyances, transfers, leases, assurances, mortgages, total discharge of mortgages, rcoveyances, reassignments and things of and relating to any property in Singapore and on such covenants and conditions as shall be required or as the Attorney shall deem fit for all or any of the purpose stated herein.

1.5 If any purchaser, vendor or lessee defaults in carrying o ut the terms of any agreement, the Attorney shall at the election of the Attorney either terminate or rescind the agreement or affirm the same and for these purposes the Attorney may sue for or receive any rental or deposit money and may give receipts for any such rental or deposit and may take such legal proceedings for obtaining rental or damages or specific performance as the Attorney shall think fit.

1.6 To defend all legal proceedings brought by any purchaser, vendor or lessee in connection with any agreement or incidental to the completion of the purchase, sale or lease of any property in Singapore.

1.7 To commence or abandon any legal proceedings and to compromise or settle all disputes or doubts which may arise in connection with the purchase, sal e or lease of any property in Singapore.

1.8 To accept from the purchaser or vendor or other parties, if any, an assurance to or from me or otherwise as the Attorney may think fit of any property in Singapore and to receive or make all payments and give and receive valid receipts for the same and enter into all or any covenants and do all other things on my behalf which may be necessary for completing the purchase or sale of any property in Singapore.

1.9 To raise and borrow whether from any individual, corporation or bank or other financial institution as may be willing to provide monies which the Attorney shall consider necessary upon the security of any property upon the terms of repayment of the sums so borrowed and payment of interests usual and to give valid receipts for the sums so borrowed.

1.10 For the purpose of receiving and repaying the sums so borrowed as aforesaid to execute and sign, seal and deliver such mortgage or charge upon any property and with and subject to all such covenants power s and stipulations as the Attorney shall consider necessary or proper.

1.11 To repay, raise, withdraw from the Central Provident Fund Board (CPF Board) from my account with the CPF Board such sums which the Attorney shall consider necessary upon the s ecurity of any property upon terms set out by the CPF Board or to charge any of my property or any part thereof to the CPF Board for securing the withdrawal of CPF monies out of anyone else's CPF Account(s) and to execute and sign, seal and deliver such mortgage or charge, consents, Deed of Arrangement or such other documents which the CPF Board may require upon any property.

1.12 To operate any existing account or accounts and open an account or accounts in my name with the bank or financial institution firm person or corporation and to deposit therein moneys belonging to me and to draw monies therefrom and invest in may name, and to buy sell shares and participate in any investment scheme my Attorney shall deem fit and to sign, draw, negotiate, endorse, accept, pay, satisfy, or deal with any cheques, bills of exchange, drafts, promissory notes or dividends or warrants respectively drawn upon or payable to me or order and also to draw and sign cheques upon any bank in my name and to sign draw or make bill s of exchange, drafts and promissory notes with power also to discount and negotiate the same.

1.13 To give notice of redemption in respect of any mortgage to any mortgagee to redeem any mortgage from any mortgagee and to pay all outstanding principal sum, interests and monies due under any mortgage.

1.14 To manage or superintend the management of and to lease all or any of the land tenements and hereditaments relating to any property in Singapore and of or to which I am now or shall become seized possessed or entitled.

2. For the removal of any doubt as to the construction of any word phrase clause or expression herein contained, I expressly hereby confirm that the Attorney is empowered, subject to any covenants and conditions as t he Attorney may deem fit to recognize or incorporate at the discretion of the Attorney, to execute and to sign seal and deliver or accept all and every document in connection with the purchase, sale, lease or mortgage of any property in Singapore, whether such documents be under seal or otherwise, and further or simultaneously or in escrow in anticipation or otherwise as the Attorney may deem fit, to execute and sign, seal and deliver all leases, mortgages, transfers, assignments, conveyances, reconveyances, reassignments or any other document, whether under seal or otherwise as the Attorney shall consider necessary or expedient for any purpose whatsoever.

3. Generally in and about the premises, to execute all manner of agreements or documents whatsoever and do such act deed and thing requisite for all or any of the purposes herein mentioned and act in relation thereto as fully and effectually as I could have done if personally present.

4. All references to property herein shall be deemed to mean and include all manner of property, whether movable or immovable, residential or commercial.

5. I hereby undertake for myself and my heirs executors and administrators to ratify allow and confirm all acts deeds or things whatsoever the Attorney shall lawfully do or cause to be done or lawfully purport to do by virtue of these presents including whatsoever shall be done between the date of this Power of Attorney becoming void or cancelled by reason of any event for the time being unknown to the Attorney doing ex ecuting or performing the act deed or thing to be ratified allowed or confirmed and the date of such event becoming known to the Attorney doing executing or performing the act deed or thing to be ratified allowed or confirmed.

This Power of Attorney shall continue to be valid and be of full force and effect for three years from the date hereof.
